Response to clarification: Art. 3 alin (1) din Legea 277/2020 privind substanțile chimice prevede- Articolul 3. Domeniile de aplicare a legii: 1) Prevederile prezentei legi se aplică producătorilor, importatorilor, exportatorilor, comercianților și utilizatorilor de substanțe ca atare și în amestecuri chimice sau în articole. Totodată, capitolul I (alin.2) din legea 913 din 25.07.2016 privind aprobarea Reglementării tehnice cu privire la cerințele minime pentrucomercializarea produselor pentru construcții prevede- Capitolul I Obiect și domeniu de aplicare: (2) Prezenta Reglementarea tehnică se aplică de toţi agenţii economici (producători, reprezentanţii lor autorizaţi, importatori, distribuitori) şi de oricare alte persoane fizice sau juridice care practică activitate de întreprinzător, produc, furnizează sau comercializează produse pentru construcţii provenite din producţia internă sau din import, organismele de evaluare a conformităţii produselor pentru construcţii care testează şi certifică produsele pentru construcţii, organismele de inspecţii, precum şi de investitori, proiectanţi, executanţi, proprietari şi utilizatorii construcţiilor care prevăd folosirea produselor respective. Concomitent, Vă informăm că autoritatea contractantă va respecta art. 72 și anume punctele a) și c) din Legea 131/2015. În urma contractării specialiștilor de la Centrul Național de acreditare din RM și Ministerul Economicii și Infrastructurii ( Direcția Urbanism, Construcții și locuințe), am fost informați că, din 25.01.2021 pentru vopsea se eliberează Aviz sanitar la care autoritatea contractantă va ține cont.De asemenea, autoritatea contractantă va ține cont de prevederile art.22 și 23 din Legea 131/2015 privind achizițiile publice.
